1. Mr. Orde's letter raises the specific

question of the case of Benares Khan and the general

Colonial

question of the co-operation by the/Governments in the

Far East and the supervision of Indian emigrants to

China.

Benares Khan was refused admission to

Hong Kong in spite of the fact that he deposited

$100 at the Consulate General in Canton and had a

definite promise of employment from one Firdos Khan

in Hong Kong. The grounds for the refusal included

the character of his prospective employer, who is

suspected of being an agitator, and use was made of

the provisions of Part II of the Ordinance No. 8 of

1934 (Immigration and Passport Ordinance), in view

of the fact that Benares Khan did not possess a

passport or other valid travel document. This decision

was no doubt influenced by the fact that in view of

the deepening economic depression the authorities are

unwilling to admit any persons likely to become

unemployed and a charge on public funds.

3. As regards X in the first enclosure to

Mr. Orde's letter, it is one thing to have suspicions

of the activities of Firdos Khan and to be disinclined

to stretch the Passport Regulations at his request;

and quite another to have sufficient cut and dried

evidence to justify his expulsion from Hong Kong.
